These Regulations regard to electronic services within the meaning of the Act of 18 July 2002 of electronic services, as part of the Service located at www.athletes.zone. Its terms form the basis for the interaction between users and the Service.
We strive every day endeavor to provide you with the highest quality of services and reliability of the provided information.
Each user starting to use this Service agrees to the following rules under the current wording of the Regulations provided on this page within our Website.
Chapter 1
Definitions within these Regulations should to be understood as follows:
Service Provider - Induro Limited Liability Company, with its registered office in Warsaw; entered into the Register of Entrepreneurs kept by the District Court for the Capital City Warsaw, XIII Commercial Division of the National Register Court under No. 0000465067; tax identification number: 522 300 68 58, owns and operates Service: www.athletes.zone
  • User / Athlete / Buyer - a person who uses the services provided electronically by the Provider to the extent described in Chapter 3
  • User / BOX / Organizer - it is a business entity who uses the services provided electronically by the Provider to the extent described in Chapter 3.
  • Services - any services provided electronically by the Service Provider to users in accordance with the provisions of these Regulations.
  • Service - Internet service belonging to the Service Provider, located at www.athletes.zone, under which the Service Provider is providing services.
  • Exercise - is any bodily activity that enhances or maintains physical fitness and overall health and wellness.
  • Workout - a physical exercise session.
  • Challenge - collection of exercises or workouts performed by one or more athletes in order to measure the results and present them in the Leaderboard.
  • Challenge with entry fee - collection of exercises or workouts performed by one or more athletes in order to measure the results and present them in the Leaderboard. Participation in the challenge is possible after paying the entry fee by the Athlete.
  • Electronic address - designation of an ICT system to enable communication by means of electronic communication, particularly e-mail.
  • The law - the system of legal norms (in the form of laws) in force in the territory of Republic of Poland.
  • Commercial information - any information used directly or indirectly to promote goods and services, excluding any information enabling communication via electronic means of communication with a particular person as well as information about goods and services not serving you reach the effect desired by the commercial entity that instructs its dissemination, in particular without remuneration or other benefits from manufacturers, retailers and service providers.
  • Registration Form - Form completed by each user when registering on the Website, the form indicates in each case what data are necessary for the efficient registration on the Site, and which are voluntarily provided by each user.
  • Leaderboard - a summary information about the user, presented by the Service related to each registered user of this Website using the rank tools provided by the Service Provider; information in the Leaderboard are modified either by the user (as a result of administration or display additional information about yourself), as well as by the Service Provider.
  • IT System - a set of cooperating equipment and software, providing processing and storage, as well as sending and receiving data through telecommunication networks using – appropriate for the type of network – terminal device within the meaning of the Telecommunications Act.
  • Electronic services – performance of the service, which is done by sending and receiving data using ICT systems for individual request of the user, without the simultaneous presence of the parties, and the data are transmitted via the public network within the meaning of the Telecommunications Act.
  • Electronic means of communication – technical solutions, including ICT equipment and working with software tools, enabling individual distance communication using data transmission between ICT systems, in particular e-mail.
  • Cookie – a small text file which is stored by the server information the Website on your computer's hard drive. The information stored in the cookie file of type Service server can read when you reconnect to your computer, but they can be read by other servers or other Internet users.
  • IP address – a unique number that usually has each computer connected to any network. IP number may be constant for a given computer (static) or may be assigned at each connection (dynamic) or it may be revised periodically in time by the ISP to the user.
  • SSL – encryption standard for data transmission over the Internet. SSL encodes the data transfer from the computer to the server service, as opposed to the usual transfer.
  • Regulations – these Regulations, introduced by the Service Provider, in each case in the current version available on the Website.
Chapter 2
General Provisions
  1. The subject of the services of the website (Service) is to collect and share its users specific information through publication on the Website:
    1. User data such as age, weight, height, sex, country and city of origin, note about user with a link to user own photo gallery or link to youtube, the picture in jpg / png.
    2. the users’ exercise time results,
    3. publications related to fitness,
    4. any other information relating to healthy lifestyle and physical culture,
    5. Users’ results information in the form of Leaderboard (rank).
  2. These Regulations specify:The Service Provider introduces these Regulations before users start registration process (account establishment).
    1. the rights and obligations of users and Service Provider and the users connected with the electronic services,
    2. the rules of releasing the Service Provider from the terms of electronic services,
    3. the rules of users’ personal data protection connected with the electronic services.
  3. The Service Provider introduces these Regulations before users start registration process (account establishment).
  4. Service Provider provides electronic services in accordance with these Regulations.
  5. Since the account establishment (end of registration process) in this Website, each user is obliged to observe the provisions of these Regulations.
Chapter 3
Website Registration
  1. Account registration is on a voluntary basis. Access to the Service is obtained upon registration involving the registration form located on the Website at www.athletes.zone
  2. Access to all resources of the Service, is possible only after the completion of the registration process.
  3. Service Provider after users’ proper completion of the registration process creates an individual user account – account name is equal with each user e-mail address.
  4. User declares that the account name does not infringe the rights of third parties and is solely responsible for the selection of the account name.
  5. The Service Provider may refuse to create an account with the specified name, and remove it if the name is already in use within the Service or has reasonable and reliable information, that the name is inconsistent with the provisions of applicable law, morality or detrimental to the good name of the third parties or the legitimate interests of the Service Provider.
  6. Registration does not require any fees.
  7. Every user establishing an account declares that:Use of the Website and its various services, is possible when user places all necessary data and information (marked as "required") in the registration form.
    1. will use electronic means of communication in order to use the Service;
    2. read the Regulations and accepted its provisions in their entirety;
    3. data is accurate and complete;
    4. data does not infringe the rights of third parties;
    5. agreed to the necessary personal data processing by Service Provider.
  8. Use of the Website and its various services, is possible when user places all necessary data and information (marked as "required") in the registration form.
  9. Service resources are dependent on the scope of data given by each user.
  10. Each user can register only one account on the Website.
  11. Each user is allowed to cancel its participation in the Service. The resignation followed by sending an email to mailbox@athletes.zone, what results in the removal of all information and data from the Website and the servers, where this data is stored. The Service Provider has the right to retain your information to the extent and for such period as is permitted by law, in order to meet the obligations arising between the user and the Service Provider in connection with user participation in the Service.
Chapter 4
Terms of Service
  1. In order to use the Service, each user must meet the following technical requirements for the collaboration with the ICT system of the Service Provider: a) have a connection to the Internet, b) have an individual e-mail account, c) have an Internet Explorer version 5.5 or higher, or other compatible browser, d) have a web browser that allows to accept "cookies".
  2. Service Provider agrees to begin providing services selected by user no later than within 24 hours of the correct account registration (account establishment). When registration occurs on a day off public holiday, then the provision of the services will begin no later than the end of the day after the public holiday.
Chapter 5
Rights and Obligations of the Service Provider and the user
  1. Service Provider reserves the right to temporarily suspend or delete user account in order to prevent or restrict access to some or all parts of the Service due to violation of the terms of these Regulations by the user as well as actions that violate the law, the rules of social intercourse or acts that are detriment to other users, the legitimate interest of Service Provider and third parties.
  2. In the case where, despite receiving a call from the Service Provider to cease operations mentioned in point 1, user does not act in accordance with the call, the Service Provider shall be entitled to remove such user's account or limit it for a period of time.
  3. The Service Provider under these Regulations is obliged to each user to not divulge to third parties any assigned user IDs and passwords that provide access to the resources of the Service. Service Provider reserves the right to disclose selected information concerning each user to authorities that have made a request for information supported by appropriate legal basis.
  4. The Service Provider shall not be liable for violation of the rules described in the preceding paragraph to third parties.
  5. Posting entries with the content of unlawful incitement to discrimination, based on sex, race, ethnicity or religion, vulgar, indecent or otherwise violate personal or legal rights of others or entities controversial; is not allowed in all accessible places of the Service.
  6. The Service Provider provides each user with the ability to search the Website for information, viewing and sorting (according to criteria specified by the Service Provider) in accordance with the ​​available search engine of the Website.
  7. The Service Provider allows each user to subscribe to the cyclic electronic newsletter, which includes sending information about new listings contained in the Service in accordance with the criteria placed by user in the registration form.
  8. The Service Provider provides each user the ability to opt out of the newsletter at any time without sacrificing the registered account on the Website.
Chapter 6
Terms of payment
  1. Services provided by the Service Provider are free of charge, under reserve of paragraph 2, 3 and 4.
  2. The Organizer may create challenge with entry fee. Entry fee is determined by the Organizer. Participation is voluntary for Athletes.
  3. The Service Provider reserves the right to remuneration for the use of certain services. In this case, the Service Provider will inform each user about introduction of new terms of 30 days in advance.
  4. In the case of Website services, which were originally free of charge, user is obliged to make a choice concerning the further use of the Service. If the user does not confirm the desirability of continuing the use of the service under the new rules within 7 days of being informed of this fact, the Service Provider ceases to provide services after this date.
Chapter 7
Payment Methods

1. Buyer for participation in the challenge with entry fee shall make cash payments through payment provider PayU.

2. The Service Provider charges the Organizer commission on every payment made by the athlete for a challenge with entry fee.

3. The amount of commission may vary based on individual agreements between Service Provider and certain Organizers.

4. After completion of the registration of Athletes in the challenge with entry fee, the Organizer receives cash transfer to the specified in his profile bank account. The amount is reduced by the commission of the Service Provider.

Chapter 8
Protection of personal data in the Service - Privacy Policy

  1. The Service Provider processes the personal data of users. Personal data shall be processed solely for the proper performance of the services, as set out in these Regulations, using for this purpose the necessary personal data, as specified in the provided by the Service registration form.
  2. The personal data referred to in paragraph 1 shall be processed by the safety rules, required by the Act of 29 August 1997 on the Protection of Personal Data (Journal of Laws No. 133, item. 883 as amended) – ‘Act’.
  3. The Service Provider shall be entitled to process the following data:Service Provider individually defines the scope of the data necessary for the provision of electronic services.
    1. Name
    2. Date of birth/age
    3. Address of residence or place of residence
    4. e-mail address
    5. Gender
    6. Weight
  4. Service Provider individually defines the scope of the data necessary for the provision of electronic services. 
  5. Other data, except as defined in accordance with paragraph 3 may be processed as a separate consent of the user, subject to the exceptions referred to in the Act and the Act on electronic services.
  6. The Service Provider is the personal data administrator within the meaning of the Act mentioned in paragraph 2, and a set of data users, was reported to the Inspector General for Personal Data.
  7. Upon transfer of personal information, the Service Provider becomes the administrator of personal data within the meaning of the Act mentioned in paragraph 2 and is subsequently responsible for their lawful processing.
  8. The Service Provider is required to maintain the confidentiality of personal data and not to disclose them to any third party, unless it results from an agreement between the Service Provider and the user.
  9. Service Provider as an administrator of personal data, made ​​everything available to protect personal data against access by unauthorized entities.
  10. The Service Provider provides users, providing personal information, enforcement of obligations under the Act mentioned in paragraph 2, the right to access their personal data, the right to request an update and request removal of personal data contained in the Service.
  11. The request referred to in paragraph 10 shall be considered as resignation from the use of resources of the Service, in whole or in part (in relation to the scope of the data that user requests to remove).
  12. The information contained in the system logs is used for technical purposes.
  13. The information mentioned in paragraph 12, used to collect general information and statistics.
  14. ‘Cookie’ files are used to provide the services and content tailored to individual needs and interests.
  15. In view of the fact that in some cases, personalized access to the content of the Website is based on ‘cookies’ exclusion of their acceptance by the browser may cause inconvenience or disable the use of certain services.
  16. Users' personal data may be used by the Service Provider for marketing purposes, in particular to transfer, posting and receiving electronic information from the Service Provider or third parties, only after the separate consent to the processing by the user.
Chapter 9
Complaints and refunds.
  1. Any disturbance in the functioning of the Service, problems and suggestions related to the provided services and payment process, may be submitted as a claim by each user by reporting that to the Service Provider (e-mail mailbox@athletes.zone).
  2. Such notification Service Provider agrees to deal with on a regular basis, however, the Service Provider reserves the right to leave the complaint without answers, if it relates to dysfunction resulting from ignorance of the Regulations, the failure by the user (to the instructions given to users on the Website or directly by the Service Provider).
  3. Complaints addressed to the Service Provider relating to the services provided by third parties through the Website will be transferred by the Service Provider immediately to relevant third party that is responsible for the implementation of the complaint.
  4. The Service Provider reserves the right to anonymous publication of content targeted by users to the Service team, on issues related to the functioning of the Service (FAQs), given advice and more.
  5. A properly filed complaint should contain the following information:The Service Provider reserves the right to leave without consideration of complaint that does not contain the data referred to in paragraph
    1. your name, e-mail address;
    2. the subject of the complaint;
    3. the grounds for complaint.
  6. The Service Provider reserves the right to leave without consideration of complaint that does not contain the data referred to in paragraph 5.
  7. The Service Provider will make every effort to ensure that the complaint has been dealt with within 14 days of its delivery. Information about decisions taken in the course of the complaint will be sent to the email address specified in the notification of complaints.
  8. Organizer agrees to communicate an additional refund policy to Athletes with respect to each event posted on www.athletes.zone
    All refunds must be processed through www.athletes.zone , unless otherwise agreed by Service Provider.
Chapter 10
Responsibilities of Provider
  1. The Service Provider will make every effort to continuous work of the Service.
  2. The Service Provider reserves the right to total temporary or partial exemption of the Service in connection with the introduction of technical improvements or modifications and maintenance.
  3. The Service Provider shall not be liable for malfunctions and functioning of the Service caused by force majeure or unlawful interference of users or third parties.
  4. Provider is not responsible for the content posted on the Site by each user in particular for their accuracy, reliability, completeness, authenticity, compliance with reality.
  5. Service Provider shall not be liable for loss of data stored in its computer systems, caused by hardware failure, dysfunction of the Internet, the loss due to the actions of third parties or force majeure and fortuitous events.
  6. The Service Provider shall not be liable for any damages resulting from the cessation of the provision of the services, as a consequence of the lack of ability to provide services for reasons attributable to the user.
  7. The Service Provider shall not be liable for damages arising as a result of ceasing to provide the services and delete the account in the cases referred to in Chapter 5, point
  8. The Service Provider shall not be liable for any damages caused to third parties arising out of the use by registered users of the services in a manner inconsistent with the Regulations or laws including the content and materials sent by these users via the Internet.
  9. The Service Provider reserves the right to assign in whole or in part any of its rights and obligations associated with the Service, without the consent and the opportunity to express any objections by users.
Chapter 11
Provisions related to the Service Regulations
  1. Service Provider is entitled to make changes to the Regulations by a unilateral decision.
  2. Any changes are regularly published in the form of a unified text of the Regulations on the Service. Amendments to the Regulations are in force from the date of their publication on the Website. Each time user logs in to the Website, agrees to read the current provisions of the Regulations.
  3. Logging on to the Website constitutes acceptance of the Regulations.
Chapter 12
Final Provisions
  1. Terms and agreements for the provision of electronic services are subject to Polish law.
  2. Any disputes arising from the Regulations or the provision of services by electronic means shall be settled by the Polish court.
